Divorce/Dissolution/ Legal Separation

Whether a Divorce, Dissolution or Legal Separation the outcome is generally the same; you will divide your property and debt, decide how to support and co-parent your children and live separate and apart.  The difference is in a divorce and dissolution you may re-marry.  In a legal separation you remain legally married and therefore cannot re-marry.  Some couples choose a legal separation as it satisfies certain tenets of their faith or religious beliefs.  Some choose a Legal Separation for more practical purposes like keeping existing health insurance coverage, where possible.  Whether a Legal Separation, Divorce or Dissolution is right for you will depend on your particular set of circumstances.  Lukacs Law is ready to help you make the decisions necessary for you to do what is right for you and your family.

The support and raising of children are legal responsibilities of both parents.  Parents have a constitutional right to the care, custody and control of their children.  However, those rights are always subject to what is in the best interest of the child.  When seeking a custody or child support order from the Court, the Court has jurisdiction to make decisions regarding the best interests of your children.  As parents, you are free to agree on how you will co-parent your children.  However, if you are unable to reach an agreement, the Court will decide.  Generally, it is in the best interest of the children to have the love and companionship of both parents.  Additional, parents are legally obligated to support their children.

Spousal Support/ Property Division
Spousal Support/ Property Division

The goal of Spousal Support and Property Division is to disentangle the spouses financially.  Typically, it requires identifying all the assets and debt then determining its ownership. There are three kinds of property the Court seeks to identify: marital, pre-marital, and non-marital.  Once, the ownership of all the property is identified, existing law determines how to divide it equally and equitably.  Any division of property and debt may be accomplished by agreement or by the Court.  Once assets and debt are divided, reasonable and appropriate spousal support will be  determined.  Any division of assets, debts and determination of spousal support will depend on your particular set of circumstances.
